Terms and Conditions

1. Who is Lovecart.in ?

Lovecart.in is website from M/s Magix Online Services Pvt. Ltd. which is registered with government of Delhi, Registration number: 258764 of 2013-2014.This page contains all terms and conditions that stand for all orders placed on this site.

2. Delivery Timings:

For all same day orders, orders have to be made before 4pm on the same day. All orders made after this shall be considered for delivery latest by the next day. We do not guarantee any timed delivery, but the client can request specific timings in the Special Instructions section of payment form. We will try our best to honour the client's request but cannot commit 100% efficiency in timing of delivery.

Delivery timings promised cannot be guaranteed in case of special circumstances like extreme weather conditions, riots, unfounded recipients etc and the order might be considered delivered for such cases and no refund will be made.

For Valentine Midnight delivery, delivery will be done between 10 PM to 12 AM

3. Discounts:

All the discounts are decided by Lovecart.in team and none of the Discount and offers can be clubbed together.

4. Address Change:

Any changes to the recipient address would be entertained free of cost if they are requested before 24hrs of the actual delivery. Changes after that will not be entertained and order would not be cancelled.

5. Order Change:

Any changes to the order would be entertained with monetary adjustments if requested before 24hrs of the actual delivery. Changes after that will not be entertained and order would not be cancelled.

6. Delivery Product:

The delivery products would be similar to the ones shown on the site but cannot be guaranteed to be exact replicas of the products shown on the site.

7. Product Arrangements:

The flower arrangements cannot be guaranteed to be exact replicas of the ones shown on site because of different vendors & different season constraints. Although the quantity of product will be the same if there have to be substitutions because of non availability of products these substitutions will be of equal or higher quality. Change of color of flowers due to non availability shall also consider under this condition.

8. Damaged deliveries:

We will cater to any reports of damaged products/ flowers on the same day of delivery only. The problem report must be supported with substantial proofs of the damage made to the product.

9. Rules for delivery:

a) Delivery will be made as per the delivery instructions. e.g. if delivery instructions state that the product must be delivered to the recipient only, it will not be given to anyone else and shall be considered delivered if recipient is not available. If recipient doesn't accept the delivery, we shall consider the order to be delivered.

b) If there is no one available at the shipping address (to accept the delivery of your order) and recipient phone is wrong or unreachable at the time of delivery, the order will not be considered late. Hence in such cases, no refunds, cancellations, liability can be made.


10. Rules for Duplicate Orders:

If Lovecart.in finds that the same order has been made twice we will try to contact the customer and get that clarified. If the customer is not contactable we will take the decision on our behalf and that will be final.

11. Dealing with Fraudulent Customers:

If we find out any fraudulent behavior from any client in terms of wrong address, unethical message, odd delivery timings or any other reason, we hold the power to reject that order or ban that customer without being answerable to anyone.

12. Rules for unfounded recipient:

In case the final customer is not available for receiving the placed order and we have strict instructions to deliver only to the intended customer the order shall be considered delivered and no refund will be made. Please refer Cancellation and refund policy for further details.

13. All courier items will be shipped using DTDC or equivalent courier. As such we cannot specify any delivery date or timing for such order. All orders will be delivered between 9am - 7pm and may take 3-5 days of shipping time depending on the product, availability and other parameters.

14. We hold the right to extend our services to any individual, organization, group or business unit. We may refuse to serve any individual, organization, group or business unit solely on our own will and we will not be answerable to anyone.

15. Lovecart.in may amend its Terms & Conditions from time to time. These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Delhi.

16. These Terms and Conditions, together with Lovecart.in cancellation and refund policy, Privacy Policy, Disclaimer and other rules and policies posted on the site, which are hereby incorporated as if set forth fully in these Terms and Conditions, constitute the entire agreement between you and Lovecart.in with respect to your use of and material available through the site, and they supersede all prior or contemporaneous communications and proposals between you and Lovecart.in with respect to this site. Any rights not expressly granted in these Terms and Conditions are reserved.

Disclaimer

2. You must respect the site's copyright in terms of product details, pictures etc and do not reproduce them anywhere without the consent of Lovecart.in. All exceptions to these these are liable for legal proceedings in IPC.

3. Accepting all orders lies under the preview of Lovecart.in. We can refuse to serve any order without giving any reason to the specified party.

4. Lovecart.in commits delivery date but if they are not met because of some unforeseen circumstances e.g. unfounded recipient, extreme weather conditions, we can not be held responsible for that.

5. All complaints related to faulty deliveries have to be reported with in 24hrs of the delivered product.

6. For all refund related policies please refer our link on refund policy.

7. All the points given in our Terms and Conditions shall be read for terms and conditions for the delivery.

8. If there is no one available at the shipping address (to accept the delivery of your order) or recipient phone is wrong or unreachable at the time of delivery, the order will not be considered late. Hence in such cases, no refunds, cancellations, liability can be made.

9. Delivery of certain branded items may not be possible/delayed under certain uncontrollable circumstances such as product is not available in the market or discontinued by the manufacturer. In such cases, similar product, nearest to the description shall be delivered. Conformance would be sought from the customer for the same through e-mail. However, if there is no response from the customer within 24 hrs., it shall be assumed that s/he has agreed to the delivery of the alternate product.

10. For same day deliveries orders have to be placed before 4:00pm on the same day. All orders made after that will be delivered latest by next day.

11. Lovecart.in may amend its Disclaimer from time to time. If we make any substantial changes in the way we use your personal information we will notify you by email or an announcement on the website.

Cancellation And Refund Policy:

Any cancellations to the order shall be made before 24 hours of the actual time of delivery to claim refund of the paid amount. No refund shall be made once the 24hr delivery window starts.

Cancellation of order shall be made with mail with Subject: " Cancellation Request" and sent to contact@lovecart.in and luvcart@gmail.com

Mail shall contain following details:-

Cancellation shall be initiated after formal order cancellation request is received at contact@lovecart.in and luvcart@gmail.com

Refund shall be made under following conditions:

a. Order was cancelled.

b. Order was not delivered to the recipient.( This does not include the case for unfounded recipient )

c. If there is any complain regarding the quality of the product being delivered, we will inquire about the same and if it is found to be true, the customer will get a full refund or the product will be replaced.

A refund can only be requested in case of service failure, our team will evaluate if an order qualifies for a refund and the decision of our management will be final. The refund amount in no circumstances can exceed the amount paid by customer, we are not liable for any loss or claim beyond the amount actually paid by customer.

In case of Cancellation, 15% charge will be applicable.

Any discounted or exempted amount can not be claimed for refund.

Any extra amount credited to Lovecart.in account may be considered for order enhancement but will not be refundable.

In all matters concerning Cancellation and refund Lovecart.in shall have the deciding hand.
